WINDY CITY GOLF LEAGUE, LLC TERMS OF USE AGREEMENT
This Terms of Use Agreement (Agreement) sets forth the legally binding terms for your use of the Windy City Golf League, LLC (Windy City Golf League) website. By accessing and/or using the web site owned, operated and/or maintained by Windy City Golf League, whether your are a Visitor or you are a Member, you are expressly agreeing to comply with and be bound by the following Agreement, as well as all applicable laws and regulations. A Visitor includes those simply browsing the Windy City Golf League website. A Member includes those that have registered on Windy City Golf League’s website. A User refers to a Visitor or a Member.
If you do not agree with this Agreement, you are not authorized to use the Windy City Golf League website and must not access or use the website.
Windy City Golf League may modify this Agreement at any time and such modification shall be effective upon posting said modifications on the Windy City Golf League website. You agree to be bound by any changes to this Agreement when you use the Windy City Golf League website after any such modification is posted. Therefore, it is important that you review this Agreement regularly to ensure you are updated as to any modifications.
TERM
This agreement shall remain in full force and effect while you use Windy City Golf League’s website and services.
USER SUBMISSIONS AND CONTENT
Please choose carefully the information you post on Windy City Golf League’s website and that you provide to other Users. Your Windy City Golf League profile may not include any photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter.
Despite this prohibition, information provided by other Windy City Golf League Users may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and Windy City Golf League assumes no responsibility or liability for this material.
If you become aware of misuse of Windy City Golf League’s website by any person, please contact Windy City Golf League immediately at the address listed below.
Windy City Golf League reserves the right, in its sole discretion, to reject, refuse to post or remove any posting by you, or to restrict, suspend, or terminate your access to all or any part of Windy City Golf League’s website at any time, for any or no reason, with or without prior notice, and without liability.
Windy City Golf League Members must submit a valid e-mail address for use by Windy City Golf League and other Windy City Golf League Members. E-mail addresses are provided to other Members strictly for purposes of facilitating league play and should not be utilized otherwise. You are solely responsible for the content that you post on or through any of the Windy City Golf League’s services, and any material or information that you transmit to other Members and for your interactions with other Users. Windy City Golf League does not endorse and has no control over content transmitted to other Windy City Golf League Users. Windy City Golf League makes no warranties, express or implied, as to the content or to the accuracy and reliability of the content or any material or information that you transmit to other Users.
MEMBERSHIP ELIGIBILITY
Use of Windy City Golf League’s website is void where prohibited. By using Windy City Golf League’s website, you represent and warrant that:
1. You are 18 years of age or older; and
2. Your use of Windy City Golf League’s website does not violate any applicable law or regulation.
Your account may be deleted without warning, if Windy City Golf League believes that you are under 18 years of age.
REGISTRATION AND PASSWORD
You are responsible for maintaining the confidentiality of your login ID and password (registration). You shall be responsible for all use of your registration, whether or not authorized by you. You agree to immediately notify Windy City Golf League of any unauthorized use of your registration. You further represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to:
1. Provide true, accurate, current and complete information about yourself as submitted to Windy City Golf League; and
2. Maintain and promptly update your registration information to keep it true, accurate, current and complete.
If you provide any information that is untrue, inaccurate, not current or incomplete, or Windy City Golf League has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Windy City Golf League has the right to immediately suspend or terminate your account and refuse any and all current or future use of the Windy City Golf League website or related products and services (or any portion thereof).
Registration data and certain other information about you is subject to the Windy City Golf League Privacy Policy. Through your use of the Windy Golf website and related services you consent to the collection and use (as set forth in the Privacy Policy) of information about you. Your personal contact information will not be provided to any Third Party.
FINANCIAL TRANSACTION
All financial transactions between you and Windy City Golf League will occur through the use of Paypal. Windy City Golf League never has access to your financial information.
Windy City Golf League reserves the rights to charge for Windy City Golf League’s services and to change its fees from time to time in its discretion. At any time, Windy City Golf League may retain any unused portion of payments paid by you in the event that you breach this Agreement.
COPYRIGHT
All content included on Windy City Golf League’s website, such as text, graphics, logos, button icons, images, audio clips and software, as well as any compilation of any of the foregiong, are the property of Windy City Golf League or its contents suppliers. Said material is or may be protected by U.S. and international copyright laws. You acknowledge and agree that content contained in sponsor advertisements or information presented to you through the Windy City Golf League website or by advertisers is or may be protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Windy City Golf League or such advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Windy City Golf League website, services, products or software, in whole or in part.
DISCLAIMER OF WARRANTIES
You expressly agree that use of Windy City Golf League’s website is at your sole risk. Windy City Golf League’s website is provided on an “as is” and “as available” basis. Windy City Golf League and its subsidiaries, affiliates, directors, officers, employees, agents, partners and licensors expressly disclaims all warranties of any kind, express or implied, including without limitation any warranty of merchantibility, fitness for a particular purpose or non-infringement. The information on the Windy City Golf League website is provided with the understanding that neither Windy City Golf League nor its Users, while such Users are participating in Windy City Golf League, are engaged in rendering legal, medical, counseling or other professional services or advice. Windy City Golf League encourages you to seek appropriate professional advice or care for any situation or problem which you may have. In particular, the activites and excercises described on Windy City Golf League’s website can be dangerous and may result in injury or death. You should consult with a licensed physician before participating in any of the activities described on Windy City Golf League’s website.
Windy City Golf League makes no warranty that the website’s services will be uninterrupted, secure or error free. Windy City Golf League does not gaurantee the accuracy or completeness of any information in, or provided in connection with the website. Windy City Golf League is not responsible for any errors or omissions, or for the results obtained from the use of such information. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of Windy City Golf League’s website is at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of such material and/or data.
LIMITATION OF LIABILITY
Windy City Golf League, its affiliates, directors, officers, employees, agents, managers, licensees and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Windy City Golf League has been advised of the possibility of such damages) or property damage, resulting from:
1. The use or the inability to use the Windy City Golf League website, products or services;
2. The cost of procurement of substitute goods and services resulting from any goods, data, information or other services purchased or obtained or messages received or transactions entered into through or from the Windy City Golf League website;
3. Use by you of any training program or any other product purchased through Windy City Golf League;
4. Your participation in any promotion or program coordinated by Windy City Golf League;
5. Personal injury not caused by Windy City Golf League’s gross negligence;
6. Unauthorized access to or alteration of your transmissions or data;
7. Statements or conduct of any third party on Windy City Golf League’s website; or
8. Any other matter relating to Windy City Golf League’s website, products or services.
You agree that Windy City Golf League’s maximum liability to you, for any reason or cause whatsoever, shall not exceed the total amount of monies received by Windy City Golf League from you.
APPLICABLE LAW
Windy City Golf League’s website is controlled by Windy City Golf League, LLC from its offices within the State of Illinois, United States of America. Windy City Golf League’s website is accessible from all 50 states, as well as from other countries around the world. By accessing Windy City Golf League’s website both you and Windy City Golf League agree that the statutes and laws of the State of Illinois, without regard to the conflict of laws principles thereof, will apply to all matters relating to use of Windy City Golf League’s website.
You agree that exclusive jurisdiction for any dispute with Windy City Golf League, or in any way relating to your use of Windy City Golf League’s website, resides in the courts of DuPage County, State of Illinois and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the DuPage County, State of Illinois in connection with any dispute including any claim involving Windy City Golf League or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.
If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
COPYRIGHT COMPLAINTS
Windy City Golf League respects the intellectual property of others, and we ask you to do the same. If you believe your copyrighted work has been impermissibly copied or used and is accessible on Windy City Golf League’s website in such a manner that constitutes copyright infringement, you may notify Windy City Golf League by providing the following information:
1. Your name, address, telephone number and e-mail address.
2. A statement by you communicating a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.
3. A statement by you made under penalty of perjury that the above information in your notice is correct and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
